For non-Muslim civil marriages in Malaysia, divorce is usually handled in the High Court. If both spouses agree to divorce and agree on the main terms, a joint petition may be suitable. Joint petition and single petition divorce
A joint petition is usually suitable when both spouses agree to divorce and agree on the main terms. A single petition may be needed when there is no full agreement, where one spouse refuses to sign, keeps delaying, cannot be found, is overseas, or where children, maintenance, assets, abuse, abandonment, or serious conflict are involved.
Do you need JPN Marriage Tribunal?
For many contested non-Muslim divorce matters, the matrimonial difficulty may need to be referred to a conciliatory body before filing, unless an exception or exemption applies. Many clients refer to this as the JPN Marriage Tribunal step. Do not guess whether JPN is required.
